We at Gunasheela Fertility Centre, including its subsidiaries and affiliates (collectively referred to as “Gunasheela Fertility Centre” or “our” or “we”), are strongly committed to respecting your privacy.

We provide medical care, surgical care, treatment and assistance to women and children (collectively, the “Services”). When you avail of any of the Services, we must collect information from you to enable us to provide the Services effectively.

In this Patient Privacy Statement and Policy (“Privacy Policy”), references to “you” and “your” means the person availing of the Services and will also include any relative, guardian, caretaker, or authorized representative (“Authorized Representative”) acting on your behalf.

This Privacy Policy discloses our practices concerning the type of information that we gather, the way we use information internally, and our policy regarding sharing information with others. This Privacy Policy also describes how you can manage your personal information and should be read in conjunction with the General Consent Form.

We may collect various types of information about you when you avail any of the Services, including the kinds of information defined and detailed in Exhibit A (collectively, “Information”).

Some of the information may be classified as Personal Information and we may collect, process, use, transfer or disclose such Personal Information for the purposes set out in this Privacy Policy.

Some of the information may be classified as Sensitive Personal Data or Information (“SPDI”) under the SPDI Rules and is treated as such under this Privacy Policy.

2.1 Purposes

We and/or our affiliates may collect, use, process, disclose, transfer, or store your Information, whether in or outside India, including for the following purposes (collectively, the “Purposes”):

A. Medical Care

  • To provide/deliver medical care, treatments and/or procedures and other related services.
  • To contact you or your Authorized Representatives in case of emergency or in relation to your medical condition, including providing appointment details, updates, test results, available services, notifications, promotional purposes, digital promotions, etc.
  • For billing and invoicing related purposes, including for enabling the request or receipt of payment for you or other third parties on your behalf.

B. Operational Considerations

  • To conduct or maintain our business or operations or those of our affiliates.
  • To analyse the use of our resources, troubleshoot problems and improve our Services.
  • For general business purposes.
  • To receive payment from you, your insurance carrier, third party administrators of insurance companies, government/corporate sponsors, or other third parties.
  • To conduct audits and quality assessment procedures.
  • To respond to any queries that you may have and to communicate information to you, including sending you e-mails or other communications regarding updates to this Privacy Policy.
  • To take feedback on our Services.
  • For any other lawful purpose.

C. Compliance

We may collect, use, process, disclose, transfer or store your Information:

  • To comply with applicable law, standard operating procedures and best practices.
  • To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving public health, potential threats to the safety of any person, violations of our policies, or as otherwise required by law.

  • To protect our rights or property or our affiliated companies.
  • To protect national security.
  • To protect the personal safety of other individuals availing the Services or the public.
  • To provide information to government agencies, regulators, courts and tribunals pursuant to statutory requirements, including those arising from the Epidemic Diseases Act, 1897, NMC Regulations, and Right to Information Act, 2005, or for any other disclosure required by or under applicable law.

D. Disclosure and Transfer of Personal Information

We may disclose or transfer your Information to:

  • Other physicians, hospitals, healthcare agencies, affiliates, or any other third parties, in relation to your medical care.
  • Third party administrators of insurance companies, government sponsors, or other third parties who may make payments on your behalf for the Services availed by you.
  • Our agents, contractors or third-party service providers that process or will be processing your Information on our behalf, including those who provide administrative or other services to us, such as lawyers, accountants, mailing houses, telecommunication companies, information technology companies and data centres.
  • A third party who acquires or proposes to acquire our business units, whether such acquisition is by way of merger, divestiture, consolidation or purchase of all or a substantial portion of our assets and who will have the right to continue to use the Information provided to us by you.

2.2 Data Principal Rights

You may have certain rights under laws of India in relation to the personal information we hold about you. In particular, you may have:

  • The right to access information about your personal data, including a summary of personal data which is being processed and the processing activities undertaken with respect to such personal data.
  • The right to correction, completion, updating, and erasure of your personal data for the processing of which you have previously given consent.
  • The right to have your personal data erased by us, in accordance with the law.
  • The right to nominate any other individual who shall, in the event of your death or incapacity, exercise your rights in accordance with law.
  • The right to withdraw consent where we process personal data based on consent. Individuals may withdraw consent by mailing us at grievanceofficer@gunasheela.com.
  • The right to a readily available means of grievance redressal by contacting grievanceofficer@gunasheela.com.

Data Principals may withdraw consent for Gunasheela Fertility Centre to use data that they have already provided to it. If they exercise these rights, Gunasheela Fertility Centre can limit or deny the provision of services for which it considers such information necessary.

Data Principals hereby give their consent to Gunasheela Fertility Centre to collect, use, store, share, and/or otherwise process their personal information in accordance with the consent form.

Investigation samples (blood or tissue) obtained for diagnostic tests may be used by research scientists or scientists affiliated with Gunasheela Fertility Centre research for the advancement of medical sciences to serve humanity for better preventive or therapeutic purposes. This will happen only if there is any sample left over after its intended medical use.

Similarly, data associated with treatment can be shared with research scientists without disclosing the identity of the individual. Data Principals have the option to disallow such research use of their sample and data.

Data Principals also agree to receive SMS / WhatsApp alerts and calls in connection with their healthcare.

2.3 Security

Gunasheela Fertility Centre, its subsidiaries and group companies and their branches (“Gunasheela”) has implemented adequate technical and organizational safeguards, in line with industry standards, to ensure the security of personal data, including the prevention of alteration, loss, damage, unauthorized processing or access of such personal data.

The key security measures to keep your personal data secure and confidential include, but are not limited to:

  • Limiting the access of employees to such personal data.
  • Ensuring that such access is on a strictly need-to-know basis, such as to respond to an inquiry or request.
  • Enforcing strict disciplinary action on employees who misuse such personal data.

2.4 Personal Data Retention

Gunasheela Fertility Centre will retain information in the formats and for the duration prescribed under applicable law or this Privacy Policy.

We will retain your information for as long as needed to provide the Services or any other purposes for which you have provided your consent to us.

We will not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force.

We will put in place measures to ensure that your information in our possession or under our control is destroyed and/or anonymized as soon as it is reasonable after:

  1. The purposes for which the information was collected are no longer being served by the retention of such information; and
  2. Retention is no longer necessary under any applicable law.

Your data may be anonymized, de-identified and/or aggregated, and the resulting data may be held by us, our affiliates, associates, agents, representatives and other authorized third parties for as long as necessary for us to provide the Services effectively or for other purposes.

2.5 Disclaimer and Limitation of Liability

You are to ensure that information provided to us is accurate, true and up to date at all times.

We will not be liable for any loss, damage or prejudice suffered by you due to your failure to provide accurate, true or up-to-date information or due to your provision of false, inaccurate or misleading information.

None of us, our affiliates, our employees, consultants or directors will be liable or obligated for any indirect, incidental, special or consequential damages with respect to collection and processing of your information under any tort, contract, negligence, strict liability or other legal or equitable theory, even if you have been advised of the possibility of such damages.

Your information may be disclosed in ways not foreseeable pursuant to the description in this Privacy Policy due to legal and/or regulatory requirements or for reasons beyond our control.

Therefore, although we are committed to protecting your privacy, we do not promise, and you should not expect, that your information or private communications will always remain private.

2.6 Changes to Our Privacy Policy

Gunasheela Fertility Centre reserves the right to modify or amend this statement at any time with or without notice for legal, administrative and technical reasons.

The effective date will be displayed at the beginning of this statement.

We may update this Privacy Statement at any time by publishing an updated version here. When we make changes to this Privacy Statement, we will amend the revision date at the top of this page.

The new modified or amended Privacy Statement will apply from that revision date.
